About African Greetings
African Greetings sells greeting cards, in both print and electronic format, in African languages. African Greetings aims to promote, encourage and celebrate African designers and artists by offering them various platforms from which to publicly showcase their work.
These Terms and Conditions were most recently updated on the 20th November 2012.
IMPORTANT NOTICE: These Terms and Conditions ("the Terms") set out the terms under which we will provide you with access to the information and services we offer from time to time via the website www.africangreetings.net ("the Web Site").
By accessing the Web Site you agree that you understand and accept as binding the Terms, as well as any additional Terms applicable to the access to and use of the Web Site and related elements. It is, therefore, very much in your interests to read them carefully. Every effort has been made to draw your attention to specific terms affecting you as a consumer through the use of underlined or bold words or provisions.
Unless otherwise stated, the Website is provided to you by African Greetings CC ("African Greetings"), a company registered in accordance with the company laws of the Republic of South Africa (Registration number: B2007/070164/23) having its registered office at Block 816/1 Hammets Crossing Office Park, 2 Selborne Road, Fourways.
African Greetings reserves the right to make changes to the Web Site, its Terms and disclaimers at any time. It is your responsibility to review any changes which are noted on the Web Site and your continued use of the Web Site thereafter will constitute your acceptance of the terms and conditions as amended by the posted changes.
African Greetings reserves the right, at any time, to suspend or discontinue the Web Site, or any part thereof, whether temporarily or permanently with or without notice. African Greetings shall not be liable to you or to any third party for any modification, suspension or discontinuance of the Web Site.
Registration as a user on this Website is at your own risk. The User indemnifies and holds African Greetings and any other service providers or affiliated entities harmless against any loss, injury or damages which may be sustained as a result of registering as a user on the Website.

This Website is controlled, operated and administered by African Greetings and its Web Site operator from their offices within the Republic of South Africa. If the user accesses this Website from locations outside of South Africa, that user is responsible for compliance with all local laws. We do not warrant that the information and services provided herein are compliant with legislation in any other jurisdiction in the world.

African Greetings reserves the right to monitor and review any and all user submissions to the Web Site. User submissions include but are not limited to text, data, graphics, audio or visual content, music, sound, chat, messages, messages, files or other material whether included in blogs, discussion fora or groups, account profiles, comments or any other space on the Web Site. African Greetings shall not be responsible for the content of any messages, designs, comments or other user submissions, and reserves the right to delete or edit submissions that it deems to be abusive, defamatory, obscene, to constitute hate speech or which it believes to be in violation of any copyright or trademark laws, or otherwise objectionable.

African Greetings may investigate complaints and/or any perceived or reported violation of the terms and conditions of use of the Web Site and take any action that it deems appropriate, including but not limited to the issuing of warnings, suspending, terminating, or attaching conditions to your access and/or removing any submissions or other material from the Web Site.
You may visit the public section of the Web Site without providing any personal information. African Greetings will in such instances collect the IP address of the user computer, but not the email address or any other distinguishing information. This information is aggregated to measure the number of visits, average time spent on the Web Site, pages viewed, and so on. African Greetings uses this information to determine use of the Web Site, and to improve content thereon. African Greetings assumes no obligation to protect this information, and may copy, distribute or otherwise use such information without limitation.
All personal information you supply to us will be treated as private and confidential. We will collect and use your personal information in order to operate, enhance and provide to you the services you request.
We will not pass your personal information on to any other person except to our service provider, Web Site operator or other relevant third parties, where it is necessary, to enable us to provide you with the services you request from us. It will neither be sold to third parties nor made available or known to others.
You may edit your personal information held by us at any time. You will update your information if it changes as detailed in the subscription process.
You agree that we may disclose to the Financial Services Board and to any other regulatory authority that is empowered to require such information by or under any legal enactment, any information they may request or require relating to you or our services.
By registering on the Web Site and using the product purchasing services you acknowledge and agree that all such usage shall be in your own capacity as a private user. All payments made through the Web Site are subject to these Terms and Conditions. All prices quoted on the Web Site are quoted in South African Rands (ZAR). The private information required for executing the payments placed through the e-commerce facility, namely your personal information and credit card details, will be kept in the strictest confidence by African Greetings and not sold or made known to third parties. African Greetings undertakes that it has taken all reasonable precautions to secure the credit card processing that is carried out to receive payment for services provided. African Greetings cannot be held responsible for security breaches occurring on your electronic device (personal computer or other electronic device used to browse the Web Site), which may result due to the lack of adequate virus protection software or spyware that you may inadvertently have installed on your device. Payment of the whole purchase price must be made for the product you wish to receive before delivery of such product can be effected. Once payment has been received African Greetings will confirm the receipt of your payment by sending an email to the email address you provide in the registration form or account held with us as a registered person with African Greetings. All prices listed on this Web Site are subject to confirmation. African Greetings will notify you by email if the confirmed price of an item you have selected differs from the price listed on the Web Site or on your purchase order. African Greetings reserves the right to limit the quantities of certain items which you, your family or any group can purchase. Once Payment has been received and processed, please allow a few minutes for electronic delivery.
Purchase price refunds will be considered as long as the request is received in writing within ten (3) days of receipt of payment. African Greetings will not process refunds for incorrect purchases or change of mind. A refund can only be paid if African Greetings has received payment from the user and it has been entered into its accounts. Refunds will only be made into the account of the user that has made payment to African Greetings, as indicated in the proof of payment. Refunds will be made in South African Rands only.
The Website has a number of security measures in place to protect the loss, misuse and alteration of information, which you provide to African Greetings. Credit card payments are secured using Extended Validation SSL with 256-bit encryption. African Greetings will keep all information that you furnish to it strictly confidential and no such information will be made available to third parties, unless required in law to do so. Your secrecy of your username and password are your responsibility and you are advised to keep them in a safe place.
The Terms contained in this user agreement will be exclusively governed by and construed in accordance with the laws of the Republic of South Africa. Any notice from us to you may be delivered by post, sms or e-mail to your provided postal/e-mail address or cellular number. Evidence of posting (either electronically or otherwise) shall be taken as evidence of delivery. Any dispute, controversy or claim arising out of or in connection with this agreement or its breach, termination or invalidity, shall be finally resolved in accordance with the Rules of the Arbitration Foundation of Southern Africa by an arbitrator appointed by that Foundation (unless otherwise agreed in writing), and shall be held in Sandton, Gauteng Province, South Africa. Nothing in this Agreement shall preclude any party from seeking interim and/or urgent relief from a court of competent jurisdiction. Should you violate these Terms or any other right of African Greetings, African Greetings reserves the right to pursue any and all legal and equitable remedies against you. If African Greetings fails to enforce any right or provision in these Terms, you agree that this failure does not constitute a waiver of such right or provision or of any other rights or provisions in these Terms. If any provision in these Terms is held to be illegal or unenforceable the validity and enforceability of the remainder shall continue in full force and effect. Failure by either party to exercise any right or remedy under these Terms does not constitute a waiver of that right or remedy. All disclaimers, indemnities and exclusions in these Terms shall survive termination of these Terms.
Graphic Design and Greeting Card/e-Card Submissions
If you are submitting a graphic design, an e-card or a greeting card design, you agree to additional Terms and Conditions.
If you are not satisfied with the level of service provided to you or believe we have made an error please send an e-mail to firstname.lastname@example.org. We will investigate the nature of your complaint and try to resolve it.
